This Privacy Policy explains how Light Up Your Holidays, Inc. (“Light Up Your Holidays,” “we,” “us,” or “our”) collects, uses, discloses, retains, and protects personal information when you visit or interact with our websites, request a design consultation or estimate, communicate with us, or purchase or receive our lighting, decorating, installation, maintenance, removal, storage, or related services.

This Policy applies to lightupyourholidays.com and its subdomains, including forms, scheduling pages, landing pages, and other online services that link to this Policy (collectively, the “Sites”), and to related communications by email, telephone, text message, social media, or other electronic means. It does not apply to employee or job-applicant information maintained solely in an employment context, or to third-party websites and services that have their own privacy policies.

1. Notice at Collection – Summary

We do not knowingly sell personal information for monetary consideration. Depending on the technologies used on the Sites and the law that applies, disclosures of online identifiers, internet activity, or approximate location to advertising partners may be treated as a “sale,” “sharing,” or targeted advertising. You may opt out as described in Sections 8 and 13.

2. Personal Information We Collect

2.1 Information You Provide Directly

Contact information. Your name, email address, telephone number, mailing address, service address, and business or organization name.
Inquiry and consultation information. The services you are interested in, requested dates, budget, preferences, design ideas, property type, messages, and other information you submit through a form, booking page, email, text, telephone call, or social media.
Property and project information. Street address, photographs or videos of a home or business, measurements, architectural or landscape details, access instructions, electrical or installation information, service history, design renderings, and information needed to prepare or perform a project.
Contract and transaction information. Estimates, proposals, contracts, electronic signatures, invoices, payment status, purchase and service history, warranty or maintenance requests, and communications about a project.
Payment information. Payments are generally processed by third-party payment processors. We may receive transaction identifiers, payment status, billing contact information, and limited payment-card details, such as card type and last four digits, but we do not intend to store complete payment-card numbers on our Sites.
Communications and content. Emails, text messages, telephone communications, feedback, reviews, testimonials, survey responses, and any files or other content you choose to send us.
Marketing preferences and consent records. Your choices about promotional emails, calls, and text messages, including the date, time, source, and scope of consent and any opt-out request.

2.2 Information Collected Automatically

When you use the Sites, we and our service providers may automatically collect information using cookies, pixels, tags, local storage, software development tools, server logs, and similar technologies. This information may include:

Internet Protocol address; browser type and version; device type; operating system; language; screen resolution; and similar technical information.
Pages, links, buttons, forms, and content viewed or used; dates and times of visits; session duration; referring and exit pages; and navigation paths.
Cookie, advertising, and device identifiers; campaign information; and interactions with advertisements or marketing communications.
Approximate geographic location derived from an IP address or device information.
Diagnostic, performance, security, and fraud-prevention information.

2.3 Information From Other Sources

We may receive personal information from:

Service providers that support website hosting, forms, scheduling, customer relationship management, email, text messaging, payment processing, analytics, advertising, cloud storage, customer reviews, and security.
Referral sources, business partners, property managers, homeowners associations, commercial clients, contractors, and other persons who ask us to contact you or provide information relevant to a project.
Social media platforms and public sources when you interact with our pages, submit a review, or make information publicly available.
Advertising and analytics providers that provide campaign, audience, conversion, or website-interaction information.

3. How We Use Personal Information

We may use personal information to:

Respond to questions, schedule consultations, prepare designs and estimates, and determine whether a property is within our service area.
Negotiate, enter into, administer, and perform contracts and projects, including design, installation, decorating, maintenance, troubleshooting, removal, and storage.
Communicate about appointments, project status, weather delays, service issues, payments, renewals, maintenance, removal, and other transactional or relationship matters.
Process payments, maintain accounting and tax records, manage insurance and warranty matters, and collect amounts due.
Provide customer support, investigate complaints, resolve disputes, and maintain service and project histories.
Operate, maintain, personalize, troubleshoot, and improve the Sites, services, advertising, and customer experience.
Measure website traffic, campaign performance, and advertising effectiveness; create aggregated or deidentified analytics; and understand customer preferences.
Send newsletters, seasonal reminders, promotions, and other marketing communications when permitted by law and consistent with your choices.
Maintain security; authenticate requests; prevent fraud, spam, misuse, and unlawful activity; protect people and property; and enforce our agreements.
Comply with legal, regulatory, tax, accounting, insurance, and reporting obligations; respond to lawful requests; and establish, exercise, or defend legal claims.
Complete a merger, financing, acquisition, reorganization, sale of assets, bankruptcy, or similar corporate transaction.
Use information for another purpose disclosed when it is collected, with your consent, or as otherwise permitted by law.

4. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients:

Service providers and contractors. Companies and individuals that provide hosting, website development, forms, scheduling, customer relationship management, communications, email and text delivery, payment processing, accounting, cloud storage, analytics, advertising, customer-review, security, legal, insurance, and related services. They may use information only as authorized by contract or law.
Installation and project personnel. Employees, installers, designers, subcontractors, vendors, delivery personnel, and other persons who need information to prepare, perform, maintain, or document a project.
Advertising and analytics partners. Providers that help measure use of the Sites, understand audiences, evaluate campaigns, or display advertising. These disclosures may constitute a sale, sharing, or targeted advertising under some state laws, even when no money is exchanged.
Payment and transaction providers. Payment processors, banks, financing providers, electronic-signature providers, accounting providers, and fraud-prevention services involved in a transaction.
Professional advisers. Attorneys, accountants, auditors, insurers, consultants, and other professional advisers where reasonably necessary.
Authorities and legal recipients. Courts, regulators, law enforcement, governmental agencies, opposing parties, or other persons when disclosure is required or permitted by law, necessary to protect rights, safety, or property, or appropriate to prevent fraud or wrongdoing.
Business-transfer recipients. A buyer, successor, lender, investor, or adviser involved in an actual or proposed corporate transaction, subject to appropriate confidentiality and use restrictions.
At your direction or with your consent. Any person or entity you direct us to contact or authorize us to disclose information to.

We do not disclose mobile telephone numbers, text-message opt-in data, or text-message consent records to third parties for their own marketing or promotional purposes.

5. Cookies, Analytics, Advertising, and Tracking

5.1 Types of Technologies

The Sites may use first-party and third-party cookies and similar technologies. Our consent-management tool may describe them using categories such as:

Strictly necessary or functional. Required to provide requested functions, transmit communications, maintain security, prevent fraud, remember privacy choices, or operate forms and scheduling tools.
Preferences. Remember settings and choices that are not strictly necessary.
Statistics or analytics. Measure traffic, usage, performance, and interactions so we can understand and improve the Sites and services.
Marketing or advertising. Measure advertising, create audiences, personalize advertisements, or track activity over time and across websites or services.

5.2 Your Cookie Choices

You may use the cookie-preference or “Manage Consent” tool on the Sites to accept, reject, or change nonessential cookie choices. You may also block or delete cookies through your browser settings. Blocking some technologies may affect Site functionality.

5.3 Global Privacy Control and Do Not Track

Where required by applicable law, we treat a recognized Global Privacy Control (GPC) or other legally valid universal opt-out signal as a request to opt out of the sale or sharing of personal information and targeted advertising for the browser or device that sends the signal. Because there is no uniform industry standard for browser-based “Do Not Track” signals, we do not currently respond to DNT signals that are not legally recognized opt-out mechanisms. Third parties may collect information about your online activities over time and across different websites or services when their technologies are enabled.

6. Email, Telephone, and Text-Message Communications

6.1 Transactional and Service Communications

We may contact you by email, telephone, or text message to respond to an inquiry, confirm or change an appointment, provide an estimate, communicate about a contract or project, send service or payment information, respond to a support request, or provide other nonmarketing communications reasonably related to your request or customer relationship.

6.2 Marketing Communications

Where required, we obtain consent before sending marketing text messages or placing marketing calls using regulated technology. Consent to marketing communications is not a condition of purchasing goods or services. Message frequency may vary, and message and data rates may apply.

To stop marketing emails, use the unsubscribe link in the message. We may retain your email address on a suppression list to honor the request.
To stop text messages, reply STOP. For help, reply HELP or contact us using the information in Section 18.
You may also withdraw consent or change communication preferences by contacting us. An opt-out from marketing does not prevent necessary transactional or service communications.

7. Payment Processing and Electronic Contracts

Contracts, electronic signatures, invoices, and payments may be administered through third-party platforms. Those providers collect and process personal information under their own privacy notices and security practices. We encourage you to review the privacy notice presented by the provider. We receive only the information reasonably necessary to administer the transaction, maintain records, provide services, and address disputes or fraud.

8. Sale, Sharing, and Targeted Advertising

We do not sell personal information for monetary consideration. We may permit analytics or advertising providers to collect or receive online identifiers, internet or electronic activity, and approximate location information through marketing technologies. Some state laws define those disclosures as a “sale,” “sharing,” or processing for targeted advertising.

You may opt out by using the Site’s cookie-preference tool, enabling GPC where recognized, or contacting us. We do not knowingly sell or share the personal information of children or teenagers in violation of applicable law. We do not use sensitive personal information to infer characteristics about you or for purposes that require a right to limit, except with consent or as otherwise permitted by law.

Financial incentives. We do not currently offer a financial incentive, price difference, or service difference in exchange for collecting, selling, or retaining personal information.

9. Data Minimization and Retention

We seek to collect personal information that is reasonably necessary and proportionate for the purposes described in this Policy. We retain each category only for as long as reasonably necessary for the purpose for which it was collected or a compatible disclosed purpose, taking into account:

The duration of an inquiry, customer relationship, contract, project, warranty, service commitment, or storage arrangement.
The time reasonably needed to maintain designs, project histories, customer preferences, and records that support future seasonal service.
Tax, accounting, insurance, licensing, safety, warranty, and other legal or regulatory obligations.
Applicable limitation periods, litigation holds, dispute resolution, collections, and the establishment or defense of legal claims.
Security, fraud prevention, backup cycles, and the integrity of business systems.
Your consent and choices, including the need to retain suppression records after an opt-out.

When information is no longer reasonably necessary, we may delete it, deidentify it, aggregate it, or securely isolate it from further use, subject to backup and legal-retention requirements.

10. Security

We use administrative, technical, and physical safeguards that are designed to protect personal information against unauthorized access, acquisition, use, alteration, disclosure, or destruction. Safeguards may include access controls, vendor-management measures, encryption or secure transmission where appropriate, employee training, backups, authentication, monitoring, and incident-response procedures. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Data Breach Response

If we discover a security incident involving personal information, we will investigate, take reasonable containment and remediation measures, and provide notice to affected individuals, regulators, law enforcement, or others when and as required by applicable law.

12. Children’s Privacy

The Sites and services are intended for adults seeking services for a home, business, or other property and are not directed to children under 13. We do not knowingly collect personal information online from a child under 13 without legally required parental consent. A child under 13 should not submit a form, book an appointment, join a marketing list, or otherwise provide personal information. If you believe a child has provided personal information, contact us so we can evaluate and, where appropriate, delete it.

We do not knowingly sell or share personal information of persons under 16, or process a minor’s personal information for targeted advertising, without the consent required by applicable law. State laws may provide additional protections for users under 18.

13. U.S. State Privacy Rights

Depending on your state of residence and whether the applicable law applies to us or the particular processing, you may have one or more of the following rights. We may voluntarily extend certain rights more broadly, but doing so does not waive an exemption or mean a particular law applies.

Confirmation and access. Confirm whether we process your personal information and obtain access to personal information we maintain about you.
Specific information. Request categories or specific pieces of personal information, sources, purposes, categories of recipients, and other information required by law.
Correction. Correct inaccuracies in personal information, taking into account the nature of the information and the purposes of processing.
Deletion. Delete personal information, subject to legal and operational exceptions.
Portability. Receive personal information in a portable and, where technically feasible, readily usable format.
Opt out. Opt out of sale, sharing, targeted advertising, or certain profiling that produces legal or similarly significant effects.
Sensitive information. Limit certain uses or disclosures of sensitive personal information, or withdraw consent to processing sensitive data, where applicable.
Recipient information. Obtain categories of third parties, and in some states a list of specific third parties, to which personal information was disclosed.
Appeal. Appeal a denial of a privacy request where state law provides an appeal right.
Non-discrimination. Exercise privacy rights without unlawful discrimination, retaliation, or denial of goods or services.

We do not currently use personal information to make decisions that produce legal or similarly significant effects through automated profiling. If that changes, we will provide any notice and rights required by applicable law.

13.1 How to Submit a Request

Using any privacy-request form or “Your Privacy Choices” link that we make available on the Sites.

Describe the right you wish to exercise and provide enough information for us to identify relevant records. We will use personal information submitted with a request only to verify and fulfill the request, maintain required records, prevent fraud, and comply with law.

13.2 Verification, Authorized Agents, and Appeals

We may verify your identity by matching information you provide with information in our records, contacting you through a previously used channel, or requesting additional information reasonably necessary for verification. The degree of verification may depend on the sensitivity of the information and the requested right.

An authorized agent may submit a request where permitted by law. We may require proof of authority and may contact you directly to confirm the request. If we deny a request, we will explain the basis to the extent required. Where an appeal right applies, submit an appeal by email with the subject line “Privacy Appeal” within the period stated in our response.

13.3 Response Timing and Exceptions

We will respond within the time required by applicable law and may extend the response period when legally permitted. Privacy rights are subject to exceptions, including information needed to complete a transaction, provide requested services, comply with law, protect security and safety, prevent fraud, exercise legal rights, maintain privileged information, or retain records that we are legally permitted or required to keep.

14. California Privacy Notice

This section supplements the remainder of the Policy for California residents and is intended to address the California Consumer Privacy Act, as amended, and the California Online Privacy Protection Act to the extent applicable.

14.2 California Rights and Requests

Subject to applicability, verification, and exceptions, California residents may request to know or access personal information, correct inaccuracies, delete personal information, opt out of sale or sharing, limit certain uses of sensitive personal information, and receive equal service and pricing. We will not use sensitive personal information for purposes requiring a right to limit unless we provide the legally required method to exercise that right.

14.3 California Minors

We do not have actual knowledge that we sell or share personal information of consumers under 16. If we learn that we have done so, we will honor the opt-in requirements that apply.

14.4 California “Shine the Light”

California Civil Code Section 1798.83 may permit California residents to request information regarding certain disclosures of personal information to third parties for their direct-marketing purposes. Submit a request using the contact information in Section 18 and identify it as a “California Shine the Light Request.”

15. Nevada Privacy Rights

Nevada residents may submit a verified request directing an operator not to make a covered sale of covered information under Nevada law. We do not currently sell covered information as “sale” is defined by Nevada law. You may nevertheless submit an opt-out request using the methods in Section 13.1.

16. Third-Party Websites, Embedded Tools, Social Media, and Reviews

The Sites may contain links to, or embed content and tools from, third parties, including booking and form providers, payment and electronic-signature platforms, maps, customer-review services, social media platforms, video services, and advertising or analytics providers. A third party may collect information directly from you or your device and process it under its own privacy policy. We do not control and are not responsible for a third party’s independent privacy practices. Review the third party’s privacy notice before providing information or using its service.

17. Changes to This Policy

We may update this Policy to reflect changes in law, technology, vendors, services, or information practices. The “Last Updated” date identifies the current version. If a change materially affects how we use personal information already collected, we will provide additional notice or obtain consent when required by law.
